1. Who we are
These terms govern your use of the Materva Troubleshoot Pro service (the "Service"), operated by Materva Inc. ("we", "us"). By creating an account or using the Service you accept these terms.
2. Acceptable use
You must not misuse the Service. In particular, you may not:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe third-party intellectual property or privacy rights;
- interfere with security (malware, probing, scraping, automated abuse);
- resell, sublicense, or redistribute the Service without our written consent.
3. Generative AI — your responsibilities
Materva produces AI-generated diagnostic guidance for licensed MEP professionals. You are responsible for your prompts, for verifying outputs against on-site conditions, for compliance with applicable codes (NEC, NFPA 70E, IMC, UPC, ASHRAE, EPA 608, OSHA, AHJ), and for any work performed. You must not use the Service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak the model.
AI outputs may be inaccurate or incomplete and are not a substitute for licensed inspection, engineering judgment, or professional advice. We may remove content, restrict outputs, or suspend accounts at our discretion.
4. Intellectual property
We retain ownership of the Service, including its software, branding, prompts, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
5. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, cancellation, taxation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until canceled.
6. Service level
The Service is provided on an "as is" basis. We do not guarantee uninterrupted or error-free operation and, to the fullest extent permitted by law, disclaim all implied warranties of merchantability and fitness for purpose.
7. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations.
8. Liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees paid by you in the twelve months preceding the claim. We exclude liability for indirect, consequential, or special damages. Nothing limits liability for fraud, death, or personal injury where prohibited by law.
9. Governing law
These terms are governed by the laws of the jurisdiction in which Materva Inc. is established.
